EMOTOS.COM TERMS OF SALE, ASSUMPTION OF RISK & LIABILITY AGREEMENT

By placing an order through EMOTOS.COM, completing a purchase, accepting delivery, or taking possession of any product sold by EMOTOS.COM (Boca Scooters LLC), you acknowledge that you have read, understood, and agree to be legally bound by these Terms of Sale, Assumption of Risk, and Liability Agreement.
1. Acceptance of Terms
By checking the box indicating your agreement during checkout, submitting payment, or accepting delivery of any product purchased from EMOTOS.COM, you agree to these Terms and Conditions in their entirety.
If you do not agree, do not purchase or use our products.
2. Inherent Risks of Riding
The purchaser understands and acknowledges that operating electric motorcycles, electric dirt bikes, electric scooters, pit bikes, motorcycles, bicycles, ATVs, UTVs, and related equipment involves inherent dangers.
These risks include but are not limited to:
- Serious bodily injury
- Permanent disability
- Paralysis
- Property damage
- Death
These risks exist regardless of rider experience, vehicle speed, terrain, weather conditions, equipment failure, rider error, or the actions of other individuals.
Purchaser voluntarily assumes all risks associated with ownership, operation, transportation, storage, maintenance, and use of any product purchased from EMOTOS.COM.
3. Off-Road Use & Legal Compliance
Many products sold by EMOTOS.COM are designed primarily for off-road or competition use.
The purchaser is solely responsible for:
- Determining whether the product is legal to operate in their jurisdiction.
- Registering or titling the vehicle where required.
- Following all federal, state, county, and local laws.
- Operating the vehicle only where legally permitted.
EMOTOS.COM makes no guarantee that any product is street legal in any state or municipality.
4. Rider Responsibility
The purchaser agrees that they alone are responsible for:
- Safe operation
- Proper maintenance
- Battery charging
- Tire pressure
- Brake inspection
- Fastener inspection
- Suspension adjustments
- Chain maintenance
- Software updates where applicable
- Proper assembly if shipped partially assembled
Failure to inspect and maintain the vehicle can result in equipment failure causing injury or death.
5. Protective Equipment
EMOTOS.COM strongly recommends every rider wear:
- DOT-approved helmet
- Eye protection
- Gloves
- Boots
- Protective jacket
- Protective pants
- Body armor where appropriate
Failure to wear proper safety equipment greatly increases the risk of serious injury or death.
6. Minors
If purchasing for anyone under 18 years old, the purchaser accepts full responsibility for:
- Supervision
- Training
- Safe operation
- Compliance with all applicable laws
7. Vehicle Modifications
Many customers modify their vehicles.
Any modification may:
- Increase risk
- Reduce reliability
- Void manufacturer warranties
- Change legal classification
EMOTOS.COM is not responsible for injuries or damages resulting from modifications performed by the purchaser or any third party.
8. Racing, Stunting & Competition
Use of any product for:
- Racing
- Stunt riding
- Wheelies
- Jumps
- Competition
- Burnouts
- Drifting
- Closed-course events
significantly increases the risk of serious injury or death.
The purchaser voluntarily assumes all risks associated with these activities.
9. Product Assembly
Some products require partial assembly upon delivery.
The purchaser is responsible for ensuring:
- Proper assembly
- Torque specifications
- Brake operation
- Suspension setup
- Tire inflation
- Chain adjustment
before riding.
10. Manufacturer Warranty
Manufacturer warranties are provided solely by the manufacturer.
EMOTOS.COM does not manufacture the products it sells.
Warranty coverage varies by manufacturer.
Unless otherwise stated in writing, EMOTOS.COM does not provide any independent warranty beyond those required by applicable law.
11. Limitation of Liability
To the fullest extent permitted by applicable law, EMOTOS.COM, its owners, employees, affiliates, contractors, suppliers, and representatives shall not be liable for any:
- Personal injury
- Death
- Property damage
- Lost wages
- Medical expenses
- Loss of use
- Consequential damages
- Incidental damages
- Punitive damages
- Emotional distress
arising from:
- Use of any product
- Improper assembly
- Improper maintenance
- Improper charging
- Rider negligence
- Third-party negligence
- Vehicle modifications
- Off-road riding
- Street riding
- Competition
- Transportation
- Storage
- Battery failure
- Component failure
- Acts of God
except where liability cannot legally be disclaimed under applicable law.
Nothing in these Terms limits rights or remedies that cannot be waived by law, including liability arising from our own gross negligence, intentional misconduct, or obligations imposed by applicable product liability laws.
12. Indemnification
To the fullest extent permitted by law, the purchaser agrees to defend, indemnify, and hold harmless EMOTOS.COM and its owners, employees, affiliates, contractors, suppliers, and agents from claims, losses, damages, liabilities, costs, and reasonable attorneys' fees arising out of the purchaser's ownership, possession, use, misuse, modification, maintenance, transportation, or resale of any purchased product, except to the extent caused by EMOTOS.COM's own negligence or other liability that cannot legally be disclaimed.
13. Inspection Upon Delivery
The purchaser agrees to inspect all products immediately upon delivery.
Any shipping damage must be reported within 48 hours of delivery.
Failure to report shipping damage within this period may affect the purchaser's ability to pursue a shipping damage claim.
14. Returns & Refunds
Unless otherwise stated:
- Vehicle sales are final.
- Special orders are non-refundable.
- Deposits are non-refundable.
- Returned merchandise may be subject to restocking fees.
- Shipping charges are non-refundable.
Return eligibility is subject to EMOTOS.COM's published Return Policy and any rights provided under applicable law.
15. Chargebacks
The purchaser agrees to contact EMOTOS.COM before initiating a payment dispute so that we may attempt to resolve the issue.
Fraudulent or bad-faith chargebacks may be challenged using order records, shipment tracking, customer communications, and acceptance of these Terms.
Nothing in this section limits the purchaser's legal rights to dispute unauthorized or legitimately disputed charges.
16. Electronic Acceptance
The purchaser agrees that checking the acceptance box during checkout constitutes an electronic signature and has the same legal effect as a handwritten signature, to the extent permitted by applicable law.
17. Governing Law
These Terms shall be governed by the laws of the State of Florida, without regard to conflict of law principles.
Any legal action arising from these Terms shall be brought in a court of competent jurisdiction located in Palm Beach County, Florida, unless otherwise required by applicable law.
18. Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall remain in full force and effect.
19. Entire Agreement
These Terms constitute the entire agreement between EMOTOS.COM and the purchaser regarding the purchase and use of products sold by EMOTOS.COM, except where supplemented by separate written agreements or manufacturer warranty documentation.
Checkout Acknowledgment
I HAVE READ AND UNDERSTAND THESE TERMS OF SALE, ASSUMPTION OF RISK, AND LIABILITY AGREEMENT.
I UNDERSTAND THAT OPERATING AN ELECTRIC MOTORCYCLE OR OTHER POWERSPORTS PRODUCT CAN RESULT IN SERIOUS INJURY, PARALYSIS, OR DEATH.
I VOLUNTARILY ACCEPT THESE RISKS AND AGREE TO BE BOUND BY THESE TERMS.
